1. Use of Our Website

By accessing this website, you agree to use it lawfully and responsibly. Prohibited activities include:

  • Attempting to access our systems without permission
  • Using the site to send unsolicited messages (no spam)
  • Copying or reverse-engineering any content
  • Submitting false or misleading information

2. Services Offered

This website provides information about our construction services, allows you to submit estimate requests, and offers homeowner education on damage and improvements. Submission of a request does not guarantee a job, timeline, or service commitment until confirmed by us in writing.

3. Intellectual Property

All content on this site belongs to Bell & Hammer or our licensed partners. You may not copy, reuse, or redistribute anything without our written permission.

4. Third-Party Links

Our site may link to external websites. We are not responsible for their content, policies, or reliability.

5. Disclaimer of Warranties

This site is provided "as is" and "as available" with no guarantees regarding uptime, accuracy, or results.

6. Limitation of Liability

Bell & Hammer will not be held liable for indirect damages or losses arising from reliance on this website or its unavailability.

7. Changes to These Terms

We may update these terms from time to time. Updates will be posted with a revised effective date.

These terms are governed by the laws of Washington State. Any disputes will be handled in local jurisdiction courts.

Project Terms of Service

1. Scope of Work

Any modifications, additions, or reductions to the original scope must be requested in writing and may be subject to additional costs and timeline adjustments.

2. Payment Terms

  • A deposit is required before work begins
  • Progress invoices will be issued at the completion of each project phase and are due within 7 business days
  • Final payment is due upon substantial completion
  • Late payments will incur a service charge of 8% per month or the maximum rate allowed by law

3. Deposits & Advance Payments

Before physical work begins: 50% of the deposit is non-refundable to cover administrative and procurement costs.

After physical work has started: 100% of the deposit is non-refundable. All deposits are applied toward the final project price.

4. Change Orders

Any deviation from the agreed-upon scope must be documented in a formal Change Order signed by both parties before additional work begins.

5. Project Timeline

Work is scheduled to commence on an agreed-upon date with an estimated completion timeline. Timelines are subject to delays caused by weather, supply chain issues, hidden conditions, or permitting.

6. Materials & Site Conditions

The client typically provides materials unless otherwise specified in the estimate. If the contractor sources materials, additional costs for procurement and delivery will apply. The job site must be accessible and free of obstructions.

7. Minimum Labor Requirement

A minimum labor charge of two (2) hours will be applied to all handyman and small-scale service tasks, regardless of the actual time required to complete the work.

8. Material & Finish Selections

All material and finish selections are considered final upon client approval or purchase. Changes after approval require a formal change order, and the client assumes all additional costs.

Finish Standards: Work meets industry standards for residential construction with uniform color when viewed under normal lighting conditions from a distance of six (6) feet. Older homes may retain imperfections, variations in texture, or minor inconsistencies inherent to the existing structure.

9. Workmanship & Warranty

All work is performed professionally and includes a limited 24-month warranty from the completion date. This warranty excludes damages caused by misuse, neglect, or external factors beyond our control.

10. Permits & Client Responsibilities

The contractor will obtain all necessary permits and coordinate inspections. The client is responsible for providing any required documentation in a timely manner.

11. Liability & Insurance

Bell & Hammer maintains general liability and workers' compensation insurance. We are not liable for pre-existing conditions or issues arising from client-supplied materials.

12. Project Cancellation

Before work begins: The deposit is refundable minus any planning costs already incurred.

After work has begun: No deposit is refundable. The client must pay for all labor, materials, and subcontractor costs incurred to date.

13. Unforeseen Conditions

The contractor is not responsible for hidden or unforeseen conditions not reasonably visible at the time of the estimate, including but not limited to rot, mold, asbestos, lead paint, water intrusion, and pest damage.

14. Client-Supplied Materials

The contractor does not warranty or assume responsibility for the quality, suitability, or performance of client-supplied materials.

15. Access & Utilities

The client must provide reasonable access to the work area, including parking, electricity, water, and restroom facilities where applicable.

16. Client Communication & Site Conduct

All project communication should go through the designated project manager. Interference or "hovering" that causes delays to the crew may result in additional labor charges. The client is responsible for restricting pet and child access to the work area.

17. Photography & Marketing Rights

The contractor reserves the right to photograph the project before, during, and after completion for documentation and marketing purposes.

18. Delays Caused by Client

If the client causes project delays (late decisions, restricted access, etc.), the contractor reserves the right to adjust the schedule and charge for any additional costs incurred.

19. Dispute Resolution

Any disputes arising from this agreement shall first be addressed through direct negotiation. If unresolved, disputes shall be submitted to mediation or binding arbitration in Kitsap County, WA.

20. Attorney's Fees

In the event of legal action, the prevailing party shall be entitled to recover reasonable attorney's fees, mediation/arbitration costs, and court costs.

21. Termination

Either party may terminate with 30 days' written notice. If the client terminates, all unpaid invoices plus incurred costs become immediately due. If the contractor terminates, any unused deposit will be refunded.

22. Entire Agreement

This agreement, together with the attached estimate and any signed Change Orders, constitutes the entire agreement between the parties.

23. Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

24. Licensed Trades

Specialty trade work will be performed by licensed contractors of their respective trades in accordance with Washington State law.

25. Subcontractor Standards & Expectations

All subcontractors working under Bell & Hammer must maintain current licenses, insurance, and bonding. They are expected to comply with OSHA safety standards, maintain professional conduct, meet agreed timelines, and use only approved materials.

26. Electronic Signatures

Signatures transmitted electronically (including via PDF or e-signature platform) shall be deemed legally binding and enforceable.
